2 PERSONAL DATA

Personal data is all information that relates to an identified or identifiable natural person. The basic personal data is your name. In addition, your gender, your date of birth, your address, your occupation, your e-mail address and your IP address also count as personal data. On the other hand, data with which it is impossible to determine your actual identity or at least requires considerable effort are not personal-related. This includes, for example, the aforementioned information if we receive it anonymously or under a pseudonym and therefore cannot assign it to a natural person.

3 PRINCIPLE OF ANONYMITY

When using silent.move websites, you remain anonymous to us as long as you do not voluntarily provide us with personal data by contacting us or applying to us using our application form.

4 PROVISION OF PERSONAL DATA

4.1 The provision of personal data is neither legally nor contractually required for the use of silent.move websites and is also not required for the conclusion of a contract. You are not obliged to provide personal data about yourself. However, you cannot visit silent.move websites without transferring the IP address you are using.

4.2 Contacting us via our application form requires the provision or collection of the data described in section 6. If you do not provide us with this data, you will not be able to use the online application option.

5 PROCESSING OF PERSONAL DATA

5.1 We automatically collect and record the following data each time you visit the silent.move website:

• Requesting domain

• Notification of successful and unsuccessful 
access • Entry and exit pages • Amount of data

• Date and time of the request 
• Name of the requested file 
• IP address of the requesting computer

This data is stored in log files on our web server as standard. The storage period for the IP address is one week, after which it is automatically deleted.

5.2 Otherwise, we only process your personal data if you voluntarily provide it to us and if this is permitted by law or if you have given your consent. We use the personal data provided by you exclusively for the purposes stated in this data protection declaration or expressly agreed with you.

5.3 We commissioned various service providers to support us in the provision, operation and maintenance of our IT systems, including silent.move websites. These include, for example, hardware and software suppliers as well as hosting providers. If such service providers work for us on our behalf, they may, as recipients, have access to your personal data. However, these service providers are then also contractually obliged to comply with data protection via a so-called order processing agreement; the statutory provisions on data protection also apply to our service providers anyway.

5.4 Your personal data will not be passed on, sold or otherwise transferred to third parties. Something else only applies if this is necessary for the processing of the communicated or agreed purposes and is permitted without consent under applicable data protection law, you have expressly consented or we are legally obliged to do so. 6 ONLINE APPLICATION

6.1 If you contact us for an application, you consent to your contact and application data including any attachments you may have sent (e.g. cover letter, curriculum vitae, certificates) being processed by us for the purpose of processing your application and contacting you . Your consent and our legitimate interest in receiving applications and contacting applicants form the legal basis for processing (Art. 6 Paragraph 1 lit. a and f GDPR).

6.2 For the purpose of establishing contact via the online application, you have given the following declaration of consent: "Yes, I give my consent that my contact and application data entered above and my application documents sent by silent.move GmbH for the purpose of processing my application, establishing contact and answering may be processed. In this context I agree to the data protection declaration. I can revoke this consent at any time with effect for the future. "

6.3 We will only process the contact and application data submitted by you via the online application in order to process your application and to respond to you. As long as we have received your contact and application data, which you have provided to us via the online application, only for processing, contacting and answering your application, we will not use this personal data for any other purposes. Apart from cases in which we are legally obliged to do so, we will not pass on your contact and application data to third parties in this case.

6.4 If your application is successful and you start an employment relationship with us, we will transfer the contact and application data you submitted via the online application to our personnel management and your personnel file. In the event of a rejection, we will delete your contact and application data three (3) months after the rejection has been sent to you, unless we are legally obliged to store it for a longer period of time, you consent to longer storage (we ask for this consent then separately) or we still need your contact and application data to carry out or process an existing contractual relationship or for verification purposes. In such a case, we will delete the relevant data after the statutory retention period or

6.5 As long as your application does not result in an employment relationship with us, you can revoke your consent at any time for the future (for contact details see section 13 below). Your contact and application data will be stored after the revocation for as long as we are obliged to do so within the framework of the statutory retention requirements or we still need your personal data for the implementation or processing of an existing contractual relationship or for purposes of verification.

7 REVOCATION OF CONSENT

7.1 You have the option of withdrawing your consent to the processing of your personal data for the future at any time within the framework of the statutory provisions. To do this, please contact the address specified in Section 13 below.

7.2 We would like to point out that the processing of your personal data that we have carried out on the basis of your consent up to your revocation will not be affected by the revocation and will remain lawful.

8 RIGHT TO INFORMATION, CORRECTION, DELETION, RESTRICTION OF PROCESSING, OBJECTION AND DATA PORTABILITY
